📝 How to File a Complaint



The process is relatively simple and does not always require an advocate.



1. Draft a Complaint



Include:


  • Your name and details

  • Description of the product/service

  • Nature of grievance and loss suffered

  • Supporting documents (bill, warranty, communication, etc.)

  • Relief sought (refund, replacement, compensation, etc.)




2. File Before the Correct Forum



  • Based on the amount of claim

  • Can be filed in the place where buyer resides or where the opposite party operates




3. Pay Nominal Fees



Fees range from ₹100 to ₹5,000 depending on the claim value.



4. Attend Hearings



After filing, the opposite party is notified. Both parties can submit documents and appear for hearing.

  • Compensation for loss, mental agony, harassment

  • Punitive damages in case of malice or fraud

  • Order to stop unfair practices

  • Litigation costs



Importantly, orders of the commission are enforceable, and non-compliance can result in penal consequences.




🔁 Appeal Mechanism



If a party is unhappy with the order:


  • Appeal lies to the State Commission (from District)

  • Further to National Commission (from State)

  • Final appeal to the Supreme Court (from National)



However, appeals must be filed within 30 days, and delay must be justified.
